HOMEPOINT SECURITY, LLC – TERMS OF SERVICE AGREEMENT

1. Definitions

1.1 “Company” refers to HomePoint Security, LLC, its officers, employees, contractors, and affiliates.

1.2 “Customer” refers to the individual or entity purchasing installation services.

1.3 “Technician” refers to any individual contracted or employed by Company to perform installations.

1.4 “Camera” refers to any surveillance or security device installed by Company.

1.5 “Installation” refers to the professional mounting, connection, and configuration of Cameras by Company personnel.

1.6 “Warranty Plan” refers to the optional Annual Warranty Plan described in Section 8.

2. Introduction

2.1 This Agreement governs the relationship between Customer and Company regarding the installation, maintenance, and use of Cameras.

2.2 By paying a deposit, scheduling an Installation, or accepting Installation, Customer agrees to all terms in this Agreement.

3. Scope of Services

3.1 Company provides exterior-only camera installation services. Interior installations are not included.

3.2 All maintenance, repair, or replacement of Cameras must be performed by Company personnel.

3.3 Company may refuse service for unsafe locations, non-compliance with safety standards, or Customer refusal to comply with instructions.

4. Installation Scheduling and Access

4.1 Appointments must be scheduled through Company-approved methods.

4.2 Customer must provide safe, unobstructed access to exterior surfaces.

4.3 Cancellations may be made at any time; however, the $100 deposit is non-refundable under all circumstances.

4.4 Company is not responsible for delays caused by weather, natural disasters, emergencies, power outages, Wi-Fi disruptions, or other events beyond its control.

5. Payment Terms

5.1 A $100 deposit is required to secure the installation appointment, regardless of package size.

5.2 The deposit is non-refundable under any circumstances if the Customer cancels, regardless of timing.

5.3 The remaining balance, including applicable Pennsylvania sales tax, is due at the time of Installation.

5.4 Accepted methods include credit/debit card processed through Stripe or cash.

5.5 All payments are non-transferable.

5.6 If payment fails or is reversed, Company may suspend Installation or cancel service.

6. Customer Responsibilities

6.1 Customer must ensure safe conditions for Installation.

6.2 Customer must provide active Wi-Fi and power sources if applicable.

6.3 Customer must notify Company of pre-existing damage or hazards.

6.4 Customer must follow Technician instructions.

6.5 Customer shall not tamper, modify, open, or attempt to repair Cameras. Unauthorized actions may result in service fees and may void Warranty Plan coverage.

7. Free Replacement Policy (Non-Warranty Customers)

7.1 Free Replacements are provided only for verified manufacturer defects or Installation errors caused by Company.

7.2 Free Replacements do not cover Customer misuse, intentional damage, or tampering.

7.3 Minor scratches, holes, or marks from normal Installation are not grounds for replacement or refund.

7.4 If damage falls outside Section 7.1, Customer must purchase a replacement Camera.

7.4.1 For non warranty customers, replacement costs are $150 per camera.

7.5 Any Free Replacement requires inspection and verification by Company.

7.6 Free battery replacements are only provided for warranty customers, for non warranty customers, battery replacements costs are $50 per camera.

8. Annual Warranty Plan

8.1 Company offers an optional Annual Warranty Plan from $199 up to $399 per year per installation address.

8.1.1 Each purchased camera package includes a one-year warranty

8.2 The Warranty Plan includes replacement of malfunctioning Cameras and components due to normal wear or failure.

8.3 The Warranty Plan includes unlimited free battery replacements.

8.4 The Warranty Plan covers all replacements except intentional damage.

8.5 Intentional damage includes vandalism, physical destruction, misuse, tampering, water damage beyond product rating, or unauthorized modification.

8.6 Customers enrolled in the Warranty Plan may not open, alter, modify, or attempt to repair Cameras.

8.7 Any tampering immediately voids Warranty Plan coverage.

8.8 Coverage lasts one (1) year from purchase date and must be renewed annually.

8.9 Warranty Plan fees are non-refundable once payment is processed. Coverage begins on the date of payment and lasts for one (1) year.

9. Liability and Indemnification

9.1 Installation involves minor risks including ladder use, drilling, and surface markings.

9.2 Company is not liable for pre-existing damage, network-related failures, or criminal activity not caused by Company negligence.

9.3 Company’s total liability shall not exceed the total amount paid by Customer.

10. Privacy and Data Use

10.1 Company collects Customer information solely for service purposes.

10.2 Company does not sell Customer data.

10.3 Data may be shared with Technicians or subcontractors strictly to perform services.

11. Force Majeure

11.1 Company is not liable for delays caused by events beyond reasonable control.

12. Dispute Resolution

12.1 Customer agrees to seek mediation first.

12.2 Unresolved disputes shall be subject to binding arbitration in Pennsylvania.

13. Governing Law

13.1 This Agreement is governed by Pennsylvania law.

13.2 Disputes shall be resolved within the Commonwealth of Pennsylvania.

14. Acceptance

14.1 By paying a deposit or scheduling Installation, Customer confirms acceptance of these terms.
