HOMEPOINT SECURITY – TERMS OF SERVICE AGREEMENT

1. Definitions

1.1 “Company” refers to HomePoint Security and its owners, officers, employees, contractors, agents, and affiliates.

1.2 “Customer” refers to the individual or entity purchasing installation services from Company.

1.3 “Technician” refers to any individual employed or contracted by Company to perform installations or related services.

1.4 “Camera” refers to any battery-powered security or surveillance device installed by Company.

1.5 “Installation” refers to the mounting, connection, setup, and basic configuration of Cameras by Company personnel.

1.6 “Deposit” refers to the non-refundable $100 payment required to secure an installation appointment.

1.7 “Service Address” refers to the address where the Installation is scheduled to take place.

2. Introduction

2.1 These Terms of Service govern the relationship between Customer and Company regarding the booking, payment, installation, maintenance, warranty, and use of Cameras.

2.2 By paying a Deposit, scheduling an Installation, accepting Installation, or using Company’s services, Customer agrees to all terms contained in this Agreement.

2.3 If Customer does not agree to these terms, Customer must not schedule or receive services from Company.

3. Scope of Services

3.1 Company provides battery-powered security camera installation services.

3.2 Company may perform both exterior and interior camera installations, depending on the selected package and service needs.

3.3 Company provides basic setup and connection assistance, including connection to Wi-Fi and basic account setup guidance.

3.4 Company does not provide ongoing monitoring services.

3.5 Company does not provide advanced IT, networking, router configuration, or internet troubleshooting services beyond the initial installation and setup process.

3.6 Company may refuse, modify, delay, or discontinue service if installation conditions are unsafe, inaccessible, unsuitable, or inconsistent with Company standards.

4. Installation Scheduling and Access

4.1 Appointments must be scheduled through Company-approved booking methods.

4.2 Customer must provide safe, unobstructed access to all intended installation areas at the Service Address.

4.3 Customer must be present at the scheduled appointment time unless otherwise approved by Company in writing.

4.4 Customer must have a working Wi-Fi connection available at the time of Installation.

4.5 Customer must have access to the Wi-Fi network name and password at the time of Installation.

4.6 Customer must have access to the email address provided at booking in order to receive account verification codes or setup communications.

4.7 If Customer is not present, does not provide access, does not provide required Wi-Fi or email access, or otherwise prevents completion of the Installation, Company may cancel or reschedule the appointment at its discretion, and the Deposit will be forfeited.

4.8 Company is not responsible for delays or inability to perform services caused by weather, emergencies, internet outages, power interruptions, access issues, or other events beyond Company’s reasonable control.

5. Payment Terms

5.1 A non-refundable Deposit of $100 is required to secure any installation appointment.

5.2 The Deposit is non-refundable if the Customer cancels, fails to appear, fails to provide required access, or otherwise prevents the scheduled Installation from being completed.

5.3 The remaining balance, including applicable sales tax, is due immediately upon completion of the Installation.

5.4 Customer agrees that final payment is due upon completion of service and may be collected on-site through a payment link, QR code, invoice, card payment, Apple Pay, Google Pay, or other Company-approved payment methods.

5.5 By scheduling service and providing payment information, Customer agrees to pay the full service amount and authorizes Company to request and collect the remaining balance when the Installation is completed.

5.6 If final payment is not completed immediately upon completion of service, Company may issue an invoice or payment request, and Customer agrees to pay it immediately upon receipt.

5.7 Failure to complete final payment may result in suspension of warranty coverage, refusal of future service, additional collection efforts, and any other remedies available by law.

5.8 Company reserves the right to withhold completion, closeout, follow-up service, or warranty-related service until payment is made in full.

5.9 All payments are non-transferable.

5.10 Company may charge sales tax on the full service amount, including product and installation, as determined by Company’s tax handling practices and applicable law.

6. Customer Responsibilities

6.1 Customer must ensure that installation conditions are safe and appropriate for Technicians.

6.2 Customer must provide truthful and accurate booking information, including name, address, email, phone number, and service details.

6.3 Customer must disclose any known hazards, damage, unstable surfaces, restricted access, pets, or conditions that may affect the Installation.

6.4 Customer must follow reasonable instructions given by Company or Technician in connection with the Installation.

6.5 Customer must not tamper with, alter, open, modify, reposition, or attempt to repair any Camera after Installation.

6.6 Unauthorized tampering, misuse, or modification may result in service fees and may void all warranty coverage.

7. Installation Conditions and Limitations

7.1 Company will make reasonable efforts to install Cameras in locations that provide strong coverage and practical visibility.

7.2 Final Camera placement is determined by Company based on safety, mounting surface, feasibility, Wi-Fi strength, and overall installation practicality.

7.3 Customer understands that requested placement may be adjusted if Company determines that another location is safer, more practical, or more effective.

7.4 Company is not responsible for weak Wi-Fi signal, signal interruptions, internet outages, delayed notifications, device compatibility issues, or performance limitations caused by environmental or network conditions.

7.5 Minor marks, cosmetic changes, drill holes, anchors, surface scratches, or similar effects from normal Installation are not grounds for refund, chargeback, or replacement.

7.6 Company does not guarantee prevention of theft, vandalism, trespassing, break-ins, or any criminal activity. Cameras are a security tool and not a guarantee of protection or prevention.

8. Cancellations, Rescheduling, and Refunds

8.1 The Deposit is non-refundable under the conditions described in this Agreement.

8.2 Company may, at its sole discretion, allow rescheduling. Any rescheduling does not waive Company’s right to retain the Deposit if Customer previously failed to appear or failed to satisfy scheduling requirements.

8.3 Once Installation has been completed, all sales and service charges are final, subject only to applicable warranty coverage.

8.4 Company’s full refund and cancellation terms, if separately posted, are incorporated into this Agreement by reference.

9. Liability and Indemnification

9.1 Customer understands that Installation may involve ladders, drilling, anchors, and attachment to building surfaces.

 9.2 Company is not liable for pre-existing damage, hidden structural conditions, weak surfaces, concealed defects, or existing property issues not caused by Company’s negligence.

9.3 Company is not liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of use, loss of data, lost profits, emotional distress, or security incidents.

 9.4 Company’s total liability under any claim shall not exceed the total amount actually paid by Customer for the specific service giving rise to the claim.

9.5 Customer agrees to indemnify and hold harmless Company from claims arising from Customer misuse, tampering, unauthorized changes, inaccurate information, unsafe conditions, or violations of this Agreement.

10. Privacy and Data Use

10.1 Company collects Customer information only as needed to provide booking, installation, communication, payment, and service-related functions.

10.2 Company does not sell Customer personal information.

10.3 Company may share Customer information with Technicians, contractors, service providers, payment processors, or software providers as necessary to perform services.

10.4 Company may retain service records, payment information, and installation notes for operational, legal, warranty, and business purposes.

11. Right to Refuse or Stop Service

11.1 Company reserves the right to refuse, stop, or modify service if:

11.2 The installation environment is unsafe;

11.3 The Customer provides incomplete, inaccurate, or misleading information;

11.4 The Customer fails to cooperate with Technician instructions;

11.5 Payment obligations are not met;

11.6 The requested work is not feasible or falls outside Company’s service scope.

12. Force Majeure

12.1 Company is not liable for any delay, cancellation, or failure to perform caused by circumstances beyond Company’s reasonable control, including but not limited to severe weather, emergencies, acts of God, internet outages, utility failures, labor shortages, or transportation issues.

13. Dispute Resolution

13.1 Customer agrees to attempt to resolve disputes with Company in good faith before initiating formal legal action.

13.2 Company may, at its discretion, require mediation or arbitration before litigation to the extent permitted by law.

13.3 Any dispute arising under this Agreement shall be handled in the Commonwealth of Pennsylvania unless otherwise required by law.

14. Governing Law

14.1 This Agreement is governed by the laws of the Commonwealth of Pennsylvania.

14.2 Any legal proceeding or dispute related to this Agreement shall be brought in Pennsylvania unless otherwise required by law.

15. Acceptance

15.1 By paying a Deposit, scheduling an Installation, accepting Installation, or completing payment, Customer confirms that they have read, understood, and agreed to these Terms of Service.

15.2 If Customer accepts these Terms electronically, including through a checkbox or online booking form, such acceptance shall have the same force and effect as a signed written agreement.
